SALE TERMS

1.                 NO WARRANTIES: All property is being sold AS IS, WHERE IS, with all faults.  There are no warranties, representations or guarantees, express or implied, as to the quality, character of condition of any of the property.  The implied warranty of merchantability is expressly disclaimed.  There is no warranty of fitness for a particular purpose.  Auction Buyers shall not be entitled to any adjustment or allowance, recession, damages or any other remedy or claim on account of the quality, character, or condition of any property purchased.

2.                 BIDDING: bids are entered for the lowest amount and then raised incrementally, using the prevailing increments.   

3.                 I have read and I agree to all TERMS AND CONDITIONS listed on the website at http://www.bmaster.com/dixieauction/terms_conditions.html     

4.                 INSPECTION:  The buyer agrees to rely exclusively on his/her pre-auction personal inspection of the property.

1.                 RISK OF LOSS:  The Buyer takes delivery including full responsibility for all risk of loss from the time the auctioneer accepts the Buyer's offer (bid).

2.                 NOTIFICATION: Successful absentee bidders will be notified before noon (USA Central Time) on April 3 , 2008 by phone, fax or email. Unsuccessful bidders will not be notified.

3.                 SETTLEMENT:  The United States and Arkansas state laws and penalties for failure to settle and pay shall apply.  The Buyer agrees to make complete settlement on all purchases by overnight check, with Bank Letter of Guarantee,  or wire transfer within one business day from the date of the auction.

4.                 DEPOSIT:  The buyer encloses a deposit check of 20% of the total bid.  If Buyer’s bid is successful, the buyer will deliver the balance due by Next-day Express Courier, if paying paid by check.  If payment is by wire transfer, the buyer’s payment must be received by no later than 3PM (USA Central Time) on April 4, 2008.  

5.                 CREDIT CARD USE: Should the Buyer choose to pay by Credit Card, Auctioneer shall ‘reserve’ the full amount of the total of the highest bid(s), prior to the sale.  If paying by credit card, the full payment will be charged out immediately upon completion of the sale. The Buyer hereby forever relinquishes any remedies whatsoever for credit card purchases made at this auction sale.

6.                 BUYER’S PREMIUM: At the end of the sale day, Auctioneer shall be entitled to credit card payment for the total of the high bids plus the 20% Buyer’s Premium.  Cash, Business Check or Bank Wire payments shall receive a 5% Cash Discount.

7.                 FAX COPY ACCEPTABLE AS ORIGINAL: Both parties hereto agree that a plain paper fax copy shall be accepted as an original.

8.                 AUTHORIZED SIGNATURE CERTIFICATION: The Buyer hereby certifies, under penalty of Perjury, that the below signature of the Buyer is an authorized signature and that the agreement is fully enforceable.

9.                 JURISDICTION: The laws of the State of Arkansas shall apply.

10.             Should any part of this agreement be ruled invalid, the rest of the agreement shall remain in force.

Auctioneer will attempt to handle the above bids under the terms of the Registration Agreement as a Courtesy to the bidder; however, bidder acknowledges that communication limitations on the Auction Day may prevent auctioneer from presenting the above bid and hereby holds Auctioneer harmless if for any reason Buyer’s bid is not presented.

Once a bid is placed, it CANNOT be changed or withdrawn after 5pm (USA Central Time) on April 1, 2008.
